Terms and Conditions

Guarantor has legal authority to contract on behalf of and engage sports development services on behalf of Participant. Guarantor/Participant agrees to pay for services and be bound and indebted to the terms contained herein. The Participant/Guarantor warrants that the Participant is healthy enough to engage in sports activity. The Participant/Guarantor does fully understand and acknowledge that; (a) risks and dangers exist in the performance of sports training; (b) participation in such activities and/or use of equipment and performance of drills and skills training may result in injury or illness including but not limited to bodily injury, disease strains, fractures, partial and/or total paralysis, eye injury, blindness, heat stroke, heart attack, death or other ailments that could cause serious disability; (c) without regard for if these risks and dangers are caused or created by the negligence of the owners, employees, officers or agents, or assigns of Company or other participants, or the negligence of other participants, the negligence of others, accidents, breaches of contract, forces of nature or other causes. These risks and dangers may arise from foreseeable or unforeseeable causes; and (d) participation in these activities and/or use of equipment, the Participant/Guarantor hereby assumes risks and dangers and all responsibility for losses and/or damages, whether caused in whole or in part by the negligence or other conduct of the Company, agents, officers, employees, assigns, or by any other person. The Client/Trainee, on behalf of myself, my personal representatives and my heirs and assigns, hereby voluntarily agree to release, waive, discharge, hold harmless, defend and indemnify the Company and it’s owners, agents, officers, heirs, assigns and employees from any and all claims, actions or losses for bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of my use of equipment or my participation in activities. The Participant/Guarantor specifically understands that I am releasing, discharging and waiving any claims or actions that I may have presently or in the future for the negligent acts or other conduct. Trainer reserves the right of assignment and subrogation.
